I’m very disappointed with how management has handled a new parking fee being introduced during my current lease.
When I moved in, I was able to use the community parking structure without a monthly parking fee. Now, residents have been notified that beginning October 1, management intends to charge $25/month for the first vehicle and $45/month for a second vehicle to use that same parking structure. addendum to continue parking there, with vehicles potentially subject to towing if they do not comply.
What concerns me most is that this is being implemented during my existing fixed-term lease, rather than at renewal.
I reviewed my lease before raising the issue with management. Paragraph 13 gives management authority to regulate the time, manner, and place of parking, which I understand. However, I have asked management to identify where my existing lease specifically authorizes them to convert the parking structure I have already been using into a new paid monthly service during the lease term.
This is particularly concerning because Paragraph 10 states that changes to Community Policies “do not change the dollar amounts owed under this Lease.” My fee disclosure also states that additional monthly fees are to be incorporated through a separate addendum after execution of the rental agreement.
Management responded by citing provisions allowing them to regulate parking, require permits, and tow vehicles that do not comply with parking requirements. However, those provisions did not answer my specific question about where the existing lease authorizes the new $25/$45 recurring fee during the current lease term.
For clarity, my lease does contain a separate optional $250 “Parking – Garage” charge, but that refers to rental of an individual/private garage and is separate from the communal parking structure involved in this new policy.
I have tried to address this directly and professionally with management and have asked them to identify the specific contractual provision they believe authorizes the new charge. I am still seeking a clear answer to that question.
Prospective residents should be aware of this experience and should carefully review all parking terms, amenity fees, community policies, and provisions allowing changes during the lease term before signing. I will update this review if management provides further clarification or resolves the issue.
